Protecting The Legal Interests Of Injured Hawaii Residents And Visitors Since 1973

Hawaii residents should be alert for signs of doctor error

A patient undergoing surgery must place a certain amount of trust in the medical staff which will conduct the operation and provide for his or her care. Hawaii residents and others usually assume that safety precautions and careful measures will be taken in order to prevent doctor error and/or surgical mistakes. Unfortunately, this is not always the case as was made evident in a recent patient incident in another state.

A woman who underwent elective surgery in 2010 claims that she never felt quite right following the operation. The discomfort became significant enough to prompt her to seek a medical examination. Needless to say, the woman and her husband were shocked to learn what her physician then discovered by doing a scan. Apparently, a medical clip was located in her body and is thought to have been left there by the surgeon who had performed her hysterectomy five years ago.

A lawsuit has been filed on behalf of the patient and states that she is suing both the surgeon and her own personal physician. The plaintiff claims that she had repeatedly reported fatigue, pain and other symptoms to her doctor for months. She is accusing him of not taking appropriate action with regard to her care. The lawsuit states that the woman required emergency surgery in order to extract the medical clip from her body and that she suffered irreparable kidney damage caused by her surgery and subsequent care.

In Hawaii, any person who suffers injury, illness or harm related to alleged doctor error or other professional medical negligence has the right to file a medical malpractice claim in court. The rules regarding damages claimed vary depending upon the circumstances of the claim being presented. Professional legal consultation would most likely benefit someone who is considering formal litigation in order to provide assistance in determining available options with regard to seeking compensation for personal suffering caused due to negligent medical care.
