Man alleges doctor error in malpractice case outside Hawaii

When a Hawaii resident undergoes any type of surgical procedure, he or she expects that all physicians, nurses, and other medical staff members will perform their jobs while adhering to the highest levels of patient safety regulations in the industry. Unfortunately, a doctor error sometimes leads to a patient/’s injury or illness. Depending on the circumstances of an individual situation, such an injury or illness can result in a permanent disability.

A man who recently underwent a hernia operation has filed a legal claim against the two doctors who performed the laparoscopic surgery. The patient alleges that he has suffered from unresolved pain due to a lymphatic leak that occurred when the doctors failed to remove a cyst intact. Rather than remove the whole cyst, the man says the doctors merely drained it.

He is seeking damages in excess of $50,000 and has requested a jury trial. His claim states that because of the doctors’ negligence, he now suffers from a permanent disability that causes him pain. The claim also mentions the medical expenses that have accrued due to the man’s condition.

In Hawaii and all other states, any patient who believes that a doctor error is the cause of his or her injury or illness is able to file a medical malpractice claim in a civil court. This allows him or her to seek compensation for damages and request that the court hold negligible parties accountable for their actions. Substandard care is an ongoing issue at many medical facilities across the nation. Pursuing legal actions in such cases is a way to pursue compensation for those who have been adversely affected.
