A college student’s family is taking legal action after a truck accident that took the young woman’s life at a Hawaii farmers’ market. The family is suing the company that owns the delivery truck involved in the accident, as well as the 23-year-old woman who was driving the truck.
The accident happened in March as the 27-year-old college student was setting up at the Kapiolani Community College Farmers’ Market. The woman driving the delivery truck for Ma’o Organic Farms reportedly backed over the other woman. A number of other people also suffered injuries.
The now deceased student would have been graduating in May with a degree in child psychology, which she planned to use to help children in Hawaii.
The victim’s family members have brought a wrongful death claim, and as part of the discovery process, the delivery truck driver’s background will be checked. The family’s attorney said that while it seems that the accident was caused by driver error, the investigation will also involve looking into the possibility that there was a defect with the delivery truck.
Also to be investigated are the possibilities of driver fatigue, medical conditions that might have contributed to the accident and whether the driver was properly licensed to operate the delivery truck.
At the time of a May 13 report, the attorney for Ma’o Organic Farms had not yet responded to the lawsuit.
In the wake of such a tragedy, grieving families are often left looking for answers. Part of a wrongful death lawsuit is the investigation that is meant to provide families with the answers they need and deserve.
